Federal Decree-Law No. (4) of 2016 on Medical Liability

The law clarifies by federal decree the concept of medical error and the obligations and prohibitions that a doctor must observe while performing his profession. The provisions of the law apply to everyone who practices one of the medical professions or professions related to them that are determined by a decision of the Minister. The law specifies the controls for performing surgical operations, gender correction operations, the prohibition of performing human cloning operations, and the inappropriate installation of artificial organs, in addition to provisions related to dealing with communicable diseases, and what is related to cases of performing pulmonary resuscitation on the patient, regulating reproduction, and cases excluded from the abortion ban. The law also addresses the tasks of the Supreme Committee for Medical Liability and the medical liability committees of health authorities, which are responsible for examining complaints referred to them by the concerned authorities, such as medical errors, and the merits of investigating professionals and insurance against civil liability for medical errors, leading to Chapter Five, which stipulates penalties.
